If not, he could be entitled? imagine also if it had knocked him over and hit his head on a step or chair..? People calling him for simply saying you dont expect to go to a venue and return injured and have damaged property because the focus of the event smashed you in the chops! club should have compo'd him straight away and nipped it in the bud, because the next time it happens it will get greater public attention and it will be for real money. think about it... the cost of bad PR value to the club for something that might happen twice a season? Should he expect to retun home injured, and smashed specs through no fault of his own? Does this mean if a kid sitting at the front gets the ball full in the face, knocking them out, perhaps breaking bones or worse requiring hospital treatment its just ok..? i ran a cafe/bistro where a woman claimed to have fallen over a step (one step), hurting/breaking her wrist (no one witnessed how she fell over), i gave first aid, arranged to get her home as she couldnt drive. Had a visit from the insurance company, then found out she got £15k.... yes f**king £15k in compo! that hurt, but again the principle i agree with in that, no one should expect to come home injured, or with destroyed property after attending your premises. And if there is a specfic danger (flying balls in the warm up) then the venue owner should have clear warning signs, also attempt to minimise accidents by re-siting the warm up shots ( temp goals in a corner) or put up parctice safety nets for the warm up. if you stage an event you are responsible for everyone 's health & safety. There's no ifs, or buts. a smart person would, after he rejected the ST offer then arranged to get his specs fixed/replaced, no fuss, no bad press. Swiss_Saint Posted August 8, 2018 Report Share Posted August 8, 2018 It may be an emotive argument but still true, the first thing more and more people are trying to do due to adverts pushing it in this country is look for someone to blame after all in your case it could not have been that the silly cow did not pick up her feet after noticing the step, no it was you the sly cafe owner that threw that step there just as she was about to enter your premises. We are all responsible for our own health and saftey, I agree where things are out of our personal control (overcrowding etc) then organisers should make allowances and control this but sometimes contrary to the fecking lawyers it really is our own bloody fault. When I was a kid if I fell out of a tree it was not the councils fault it was mine , if I trip over a step its my fault for not seeing it or being dumb enough to not lift my feet. Compensation and health and saftey has its place in a civilised society but lawyers have seen fit to screw everyone over with the if there is blame there is a claim rubbish. Goodness knows how many times this sot of thing happens throughout a season. The player (not sure who it was) went over to check the guy was ok and then went back to play with his pals. It is a personal injury claim of questionable harm on a very specious premise that someone was responsible for keeping the ball away from his face. There are legal precedents where a golfer lost a claim against a golf club when a stray shot hit him on the head. If i recall correctly, a successful claim was made against a cricket club when the ball went out the ground and hit a passer-by.
