Another big nail in the coffin but I'm convinced that Ashley will be biding his time to grab the remainder of what is that organisation and then turn it into what he wants. .if the SFL allow him to do it . The truth is that he is a guy that does have almost endless resources, certainly way beyond king's 18 mill'. .

That Daily Rag bollocks isnae news. It's a regurgitation of the fact surrounding the original retail deal- that neither side should discuss the details. The DR leaked that sevco couldnae get out of it for seven years - back in August.

It wasn't Ashley who leaked it so it had to be the King crowd. They were reminded of that fact of the original deal - back in August, as I said.

So why is it being broadcast again? Why this morning... today? It's not news!

Possibly to distract (blameAshley) for the state of the accounts that really ought to be published soon.. (This would be no biggie at all for a normal Clumpany... But gossips are predicting as ever, doom arriving, wearing light blue.)

Still overspending, still beyond its eyeballs in debt, still without a line of credit (other than the kindness of his Big Mikeness)... Good job the SFA are overseeing the Scottish game, and ensuring fair play and that Hibs (and all us other diddy club fans) are not being cheated.

Come on now, is there any place for sarcasm in such a fine thread ? It is only a matter of time before that ship finally sinks as the leaks become uncontrollable. .

I had had beer.

The latest reprise of the tax case is also on the horizon (today). If HMRC don't win today it'll take it on to a higher court, (outwith Scotland) which will be less likely to view the DEID club as "a special case").

However, that's history, now (including the fact that the DEID club admitted to 5 counts of tax cheating and accepted 35 others) but it would be right for the full nefarious practice that was still denied, to be out in the open.

We were all cheated. It wasn't enough for them to have to have more fans and more money, they also had to cheat...

And then, let's not forget, there's all the upcoming court cases.... Green; Green, Whyte et al...

Where, snlt, did you get the idea of finally sinking?

There is much floundering and waving and drowning yet to come.

And the bbc don't mention there's an Operating loss of £9.94M.

Or that in the small print towards the end (of the published accounts) there's still £250k with £150k expenses (and interest accruing) unresolved from their acceptance of the appalling 5 way deal that allowed sevco to slither into Division 4. They accepted the debt then, but now feel it need not be paid.

SPFL disagree.

There was apparently a meeting on 29/30 October. I'm sure I must have missed Keef Jackson's investigative reporting of that...

It's only a wee debt. Real Ranjurs men don't need to pay wee debts, of course. Only little peepul do that.

On a similar matter, Charlie Green's court costs could be a couple of hundred thousand....

Fascinating stuff! :)

And now - amazingly - the courts agree! :)

Lord Drummond Young summing up...

“We accordingly conclude that the primary argument presented for HMRC is correct: the payments made by the respondents to the Trustee of the Principal Trust in respect of employees were emoluments or earnings and are accordingly subject to income tax. Furthermore, those payments were made at the time of payment to the trustee of the Principal Trust, with the result that the obligation to deduct tax under the PAYE system fell on the employer who made such a payment.”

Perhaps not great news for Thommo, however...

... though it could be argued the burden still falls on the DEID club.

The LNS verdict was based on the fact that the use of EBTs was legal.

It has now been found that the use of EBTs was illegal.

This now needs to be revisited.

Rangers have been found guily of the biggest cheat ever in sporting history.

For a start, all trophies and titles that they won during this period now need to be stripped.

St. Mirren are therefore the rightful winners of the League Cup in 2010...

In addition... the brand new club, formerly known as Sevco, agreed to take on any punishments handed out to the real Rangers FC.

Any punishment handed to the real Rangers FC for cheating on this scale would surely be a sine die banning from football...

Ye would think that having won the BTC... HMRC would be desperate to get any money they can from the club - especially if they're still claiming to trade as the same club with the same history....

Not sure how this would be viewed under trading laws etc.

Expect Mr King will try to distance the newco from the oldco in the coming weeks. Remember that a few months back he was talking about bring the "oldco" back from the dead...

None of that is relevant.

The FACT is that they are completely different legal entities.

The main issues here are:

1. The LNS verdit on Rangers cheating was based on the EBT's being legal. They have now been found to be illegal.

2. Sevco agreed to take on any football punishments handed out to the real Rangers in return for being allowed entry to the then 3rd Division.

As a consequence...

If the LNS verdict is revisited then the ONLY suitable main punishment would surely have to be a sine die expulsion from football.

And Sevco would need to take that punishment on...

In addition, the real Rangers FC will have to be stripped of all titles and trophies won during that period.

Clubs have been thrown out of the Scottish Cup and had points deducted for fielding ineligible players in the past. Based on the number of ineligible players Rangers must have fielded over a decade or more then I can't see past a sine die banning.

Quote:

"The judges ruled that if income was derived from an employee's services, in their capacity as an employee, it was an emolument or earnings and "thus assessable to income tax".

Delivering the opinion of the court, Lord Drummond Young said: "That accords with common sense".

"

It seems the Judge/s in the two previous Tribunerals (where they found in Rangers FC's favour) had no common sense...

or was it some other reason I wonder? lipsrsealed.gif

Sevco immune to this, sadly.

As I explained in my previous posts, they aren't immune.

They agreed to take on any punishments handed out to the real Rangers.

Lord Nimmo Smith’s judgement was on the basis that EBTs were legal. As they are now illegal, that judgement now needs to be revisited.

Any punishment that is then handed out has to be taken on by Sevco.

Any punishment would surely have to be a sine die banning from football.
